Terms and Conditions for Use of Dr. Dish Shooting Machine

Effective Date: 11 October, 2024

1. Acceptance of Terms By using the Dr. Dish Shooting Machine (the "Machine"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree, please do not use the Machine.

2. Eligibility You must be at least eighteen (18) years old to use the Machine. Users under this age must have parental or guardian consent.

3. Use of the Machine

  • The Machine is intended for basketball training and practice purposes only.
  • Users must follow all operational instructions and safety guidelines provided by the Machine.
  • Users are responsible for ensuring that the area around the Machine is safe and free of obstacles.

4. Liability Waiver

  • By using the Machine, you acknowledge and accept that there are inherent risks associated with its use, including the risk of injury.
  • You agree to release and hold harmless Port Macquarie Basketball Association Inc. ("PMBA"), its owners, employees, and agents from any claims, damages, or liabilities arising from your use of the Machine.

5. Equipment Care

  • Users are responsible for the proper use and care of the Machine.
  • Any damage or malfunction must be reported immediately to PMBA.
  • Users may be held financially responsible for any damage caused by improper use.

6. Reservations and Fees

  • The Machine must be booked through the online booking system on the PMBA website.
  • Payment in full is required at the time of booking.
  • Cancellations must be made at least 24 hours in advance. The booking fee, in entirey, will be forfeited after this time. 

7. Code of Conduct

  • Users are expected to behave in a respectful manner towards others while using the Machine.
  • Any disruptive or harmful behavior may result in immediate termination of access to the Machine.

8. Modifications PMBA reserves the right to modify these Terms and Conditions at any time. Continued use of the Machine constitutes acceptance of any changes.

9. Governing Law These Terms and Conditions are governed by the laws of New South Wales, Australia.
